We offer E-Design and 3D visualization services for residential and commercial spaces to clients including other design firms wanting to outsource. Our service does not include execution and management of the project.

THE SERVICE

Siya Interior Design is an India-based design firm offering E-Design and 3D visualization services for residential and commercial spaces. The services of Siya Interior Design are limited to providing design documents, which can then be used as a guide by the clients and/ or their contactors to implement the project themselves.

Siya Interior Design will provide support for queries and clarifications related to the drawings and design ideas contained in the design document for a limited period of two months from the date of final submission of the design document. However, Siya Interior Design will not be responsible for the oversight of the project in anyway remotely or otherwise.

All communication will be done via e-mail.

CONTRACTORS & CONSULTANTS

Siya Interior Design does not provide contractor services. For all works requiring contractors and/or consultants to implement the designs provided by Siya Interior Design, the client will enter in a contract directly with each contractor and/or consultant. Siya Interior Design provides no warranty, guarantee, certification, or responsibility for the performance, quality, or timely completion of any work performed or materials installed by contractors, nor their agents or employees.

It will be the responsibility of the client that all work related to electricals, woodwork, construction, and other installations be done by, and in consultation with certified professionals to meet the local standards and guidelines.

Siya Interior Design will not be involved in carrying out modifications to structural, mechanical, and electrical systems like heating, air conditioning, plumbing, electrical, ventilation etc. Similarly, client would be responsible for obtaining permissions and/ or approvals required by governmental or any other agencies related to the property and its governance.

DEFINING THE SCOPE

The final scope of the work will depend on the package selected by the client, initial consultations, and the response to the client questionnaire. Accordingly, the final cost and timeline of the project will be finalised.

SITE INFORMATION

The Client shall make available to Siya Interior Design essential details with respect to the project site such as dimensions, layouts/ floor plans, etc., as supplied by the builder of the space; photographs from all directions; and any other information required to facilitate the design.

DRAWINGS

Interior design plans/ layouts, drawings, and visualizations contained in the design document provided by Siya Interior Design are conceptual in nature, and are not engineering or architectural drawings. The drawings and documents submitted by Siya Interior Design are based on the dimensions of the space provided by the client. Siya Interior Design is not responsible for incorrect measurements provided by the client. Clients are advised to verify all measurements on site prior to the commencement of work. Any discrepancy found in our design documents should be brought to our notice before commencement of the work but not later than one week after submission of the final document.

DESIGN FEE

Siya Interior Design shall be compensated on a lump sum basis, and the amount would be estimated considering the per square feet rate of the package selected by the client. Any extra content added beyond the scope of the package would be negotiated at additional cost. Taxes and levies would be charged in accordance with the laws prevalent in India.

Following the industry practice, Siya Interior Design will start the design work only after receiving the full or negotiated milestone-based design fee in advance.

Payment would be accepted only through direct deposit in bank account of Siya Interior Design or through online payment system of PayPal.

PURCHASING

Siya Interior Design will not be involved in purchasing of any item directly or indirectly or in hiring of contractors and vendors. It would be entirely at the discretion of the client to select sources for the purchase of materials or services of contractors and vendors. The client would be responsible for selecting the products, negotiating the prices, and setting terms and conditions for supply of the products and services.

INTELLECTUAL PROPERTY RIGHT

The drawings and documents prepared by Siya Interior Design remain the property of Siya Interior Design and cannot be used by the client for any purpose other than completing the project for which it is intended.

PHOTOGRAPHS & PUBLICITY

Client agrees to send photographs and videos of the project on its completion to Siya Interior Design for its business purposes, including, but not limited to press, publications, online, social media, marketing, advertising, and print.

Client’s name and location may be used in connection with the documentation unless specified to the contrary.

Additionally, if the client or the client’s agents document the project and the same is released publicly, Siya Interior Design shall be given credit as the designer of the space.

TERMINATION

If the client terminates the agreement, no refund will be made by Siya Interior Design due to the nature of the work. 

Client agrees to take no action which is intended or would reasonably be expected to harm the reputation of Siya Interior Design or which would reasonably be expected to lead to unwanted or unfavourable publicity to Siya Interior Design.

LIMITATION OF LIABILITY

Neither Siya Interior Design, nor its consultants, agents, or employees shall jointly or individually be liable to the client for any damage or harm, monetary or material, caused during or after the implementation of the design.

DISPUTES

All disputes arising from the design service work agreement between Siya Interior Design and the client shall be resolved in accordance with the binding private arbitration in state of Uttar Pradesh, India with each party to bear its own fees and costs. This agreement is governed by Uttar Pradesh, India law.

TERMS

The parties agree that the terms of this agreement may be changed only through a written document signed by both parties and that no verbal changes or waivers are permitted.

ACCEPTANCE

Signing below, the client and Siya Interior Design acknowledge terms and conditions contained within this agreement and further acknowledge that this agreement, along with subsequent written correspondence regarding design service, fees, etc. together represent a complete contract between the client and Siya Interior Design.
